The State Department of Health has recently clarified that if Maui County settles its Lahaina Injection Wells lawsuit, “DOH has no plans to enforce NPDES permit requirements against existing septic systems and cesspools.” This means that a settlement does not impact septic and cesspool owners on Maui–only the Lahaina Wastewater Facility, which for 30 years has been pumping 3-5 million gallons of sewage every day into injection wells that deteriorate West Maui reefs–would need to apply for a permit to comply under the Clean Water Act.
Maui County should withdraw its lawsuit from the U.S. Supreme Court and focus upgrading its Lahaina facility, instead of continuing to fight the law. Take action today at bit.ly/lahaina-19
